The controversy stems from Burnham’s retention of Bridget Phillipson as Minister for Women and Equalities and Shabana Mahmood as Home Secretary. Trans organization Trans Actual has criticized these appointments, suggesting that the policies of the current government led by Starmer will persist under Burnham’s leadership.

Phillipson came under fire following the updated Equality and Human Rights Commission (EHRC) code, which stipulates that single-sex facilities such as toilets, changing rooms, hospital wards, and refuges must be accessed based on an individual’s biological sex rather than gender identity.

Despite Burnham’s strong history of supporting LGBTQ+ rights, including his involvement in protests against discriminatory laws like Section 28, his recent stance on certain issues has sparked debate. While he has championed various LGBTQ+ rights initiatives over the years, such as repealing Section 28 and supporting same-sex marriage, his approach to current challenges has raised questions within the LGBTQ+ community.

Burnham has shown support for ending conversion therapy and has publicly apologized for past mistreatment of LGBTQ+ individuals in Greater Manchester. Additionally, he has advocated for the reform of the Gender Recognition Act to simplify the legal recognition process for transgender individuals.

In response to criticisms regarding his recent decisions, Burnham has emphasized the importance of implementing EHRC guidelines in a fair and compassionate manner, ensuring the protection of single-sex spaces without further marginalizing vulnerable communities.

Trans Actual has urged Burnham to engage with the transgender community and reject any regressive policies from previous governments to demonstrate a genuine commitment to advancing LGBTQ+ rights under his leadership.
