The Saskatoon development appeals board recently upheld regulations regarding a residence in the Nutana neighborhood that exceeded height restrictions. The three-story house on University Drive, valued at $1.6 million, surpassed the maximum allowable height by 1.4 meters and also exceeded width limitations.
The violations were discovered during an inspection in May, prompting the city to issue a stop work order. The current owners, Curtis and Rachelle Kelln, who purchased the property from the late developer Karl Miller’s estate, appealed the decision. They claimed they were unaware of the size limitations, as did the city staff who conducted multiple inspections during the construction process.
Jonathan Naylor, president of the Varsity View Community Association, supported the board’s ruling, emphasizing the importance of regulations to prevent oversized houses that could impact neighboring properties and green spaces. While pleased with the outcome, Naylor raised concerns about oversight by the previous owner and city inspectors.
Neighbour Douglas Tompson expressed sympathy for the current homeowners, noting their innocence in the situation. Both Tompson and Naylor speculated that the matter might escalate to legal proceedings due to its complexity. The Kellns are considering their options following the board’s decision, which could potentially be appealed to the Saskatchewan Municipal Board within the next month.
Efforts to modify the house, such as removing the third storey, were deemed impractical and costly according to an affidavit submitted by Curtis Kelln. The situation remains unresolved as the homeowners weigh their next steps.
