A couple in Florida avoided jail time for child neglect charges after making an out-of-court settlement with prosecutors. Brian, 40, and Sara Wilkes, 37, were taken into custody in October 2025 when beach visitors alerted the authorities about an unattended baby on Miramar Beach. The parents had not returned to check on their six-month-old daughter, who was being looked after by kind strangers at the nearby Hilton Sandestin Beach Golf Resort and Spa. Upon the parents’ return, they confessed to leaving the baby alone under their beach tent while they took their other children for a walk and lost track of time.
Fortunately, the baby was unharmed, and paramedics confirmed her well-being despite the extended period she was left alone. Major Dustin Cosson of the Walton County Sheriff’s Office deemed the duration the child was alone as excessive and highlighted the risks of leaving a baby unattended. The Florida Department of Children and Families intervened, placing all Wilkes’ children in state custody until relatives from Texas could take over their care.
The parents managed to avoid jail by entering a deferred prosecution agreement, as detailed in court documents. They each paid fines, performed community service, attended parenting classes, and were restricted from visiting Walton County, Florida. Failure to comply with the agreement terms within a year would result in the resumption of neglect proceedings. Compliance and good behavior are essential for the parents to prevent further legal action.
