A woman who was left with nothing after losing a legal battle with her successful daughters over a £1 million inheritance has obtained permission to bring them back to court for a second round of litigation.
Camilla Bains and her daughters have become a distressed family due to a severe fallout that occurred after Camilla’s divorce. Previously, their relationship was so close that one daughter, Sonia, a doctor with ties to Premier League clubs, selflessly donated a kidney to save her mother’s life.
To maintain her benefits, Camilla allocated a £340,000 divorce settlement to her daughters and destroyed documents regarding her ownership of her £800,000 home, transferring it into Sonia’s name.
When Camilla attempted to reclaim her property and funds from her daughters, they found themselves in a legal battle at Central London County Court. Camilla accused her daughters of colluding to deceive her, while Sonia accused her mother of envy and greed towards their achievements.
In a prior ruling, Judge Nigel Gerald determined that Camilla had willingly relinquished her assets to retain her benefits and later regretted her decision. However, the High Court recently permitted Camilla to reopen the dispute over the house after she was left in dire financial straits following the initial court decision.
Camilla’s barrister argued that it was unjust for her to be left without any assets and sought permission to challenge the previous ruling. The barrister highlighted an August 2019 note central to the property dispute, emphasizing that it did not constitute a legal transfer of ownership as required by law.
Granting permission for a full appeal, Mr. Justice Fancourt acknowledged the potential validity of the arguments presented, signaling a future court date for a comprehensive hearing on Mrs. Bains’ appeal.
